General

The General Terms and Conditions of the online shop www.kgl.si/shop are drawn up in accordance with the Consumer Protection Act (ZVPot-UPB2), the Personal Data Protection Act (ZVOP-1), the General Data Protection Regulation (GDPR) and the Electronic Communications Act (ZEKom-1).

The online shop www.kgl.si/shop (hereinafter also referred to as the “online shop”) is operated by KGL d.o.o., Ponoviška cesta 13, 1270 Litija, Slovenia, registration number: 1193074, tax number: 29498856, which is also an e-commerce service provider (hereinafter also referred to as the “Provider”).

The Provider reserves the right to make any changes to the General Terms and Conditions without special notice. Changes or amendments are effective from the moment of publication and are binding on the user.

Contract and purchase order with payment obligation

The price of the product, the value of the VAT and the postage costs are shown in your shopping cart before you complete your order. You will be notified of all the details of your online order to the email address you provided in the shopping cart when entering your details. If you do not receive one, there is a possibility that you have entered the wrong email address.

A purchase agreement is concluded between the consumer and the Provider when the consumer makes a purchase on the www.kgl.si/shop website and receives an electronic confirmation from the Provider at their email address. From that moment on, all prices and other conditions are fixed and apply to both the Provider and the consumer.

The purchase agreement is stored electronically with the company and can be obtained on a written request.

Invoicing

The Provider sends a invoice to the customer with the delivery of the ordered items.

The invoice includes a breakdown of the prices and all costs related to the purchase. It is the customer’s responsibility to verify the accuracy of the information before placing an order.

Prices and VAT

All prices are in euros and include VAT (the company is subject to VAT). All orders are subject to current prices. The purchase price will be the price valid at the time of the confirmation of payment.

While the Provider makes every effort to ensure that the information on the website is accurate and up-to-date, there may be inaccuracies in the publication of prices, delivery times, descriptions and product features. As it is not always possible to enter all changes on the website at the same time as the change occurs, the Provider will always inform the customer of the changes and give the customer the opportunity to cancel or exchange the product ordered.

Payment methods

In the online shop, it is possible to pay cash on delivery (the buyer pays the cost of the purchase upon delivery), by invoice, or by debit or credit card – Maestro, Activa Maestro, MasterCard, Visa (if the payer’s Maestro payment card allows it).

Card payments are made via Stripe. Card data is not recorded on the company’s server, so your security is 100% guaranteed. Stripe ensures maximum transaction security. Credit card authorisations are carried out in real time, with instant verification of data with banks.

In the case of cash on delivery, the buyer pays the delivering postman of Pošta Slovenije for the goods and postage in cash upon delivery or collection, while in the case of payment by invoice, the buyer transfers the value of the purchase to our bank account (after receiving the invoice with the payment details in the e-mail) prior to the delivery of the goods. If you pay by debit or credit card, your order will be processed immediately. Once your card details have been verified and approved by Stripe, your parcel will be sent to the post office.

Delivery and delivery charges

The contractual partner for the delivery of parcels is Pošta Slovenije. The buyer is responsible for the postage if the purchase amount is less than €50, otherwise the shipping costs are FREE. The delivery charge will be indicated at the time of completion of your order and will be included in the invoice you will receive with the products you order.

All orders will be shipped within three to five working days of receipt of the order. For products where a longer delivery time is specifically indicated, this will be taken into account. If a product is out of stock, we will notify you by email or phone within 3 working days of receiving your order and we will work together to find a solution.

Return of goods

Within 14 days of receipt of the goods, the consumer may withdraw from the contract for the purchase of the goods by written communication, without giving any reason. A message is considered on time if it is submitted within the prescribed time limit. The customer must send back the goods to the Company undamaged and in the same quantity within 30 days of the notice of withdrawal, unless the goods are destroyed, damaged, lost or reduced in quantity without any fault on the part of the consumer. The original invoice you received with the goods must accompany the returned goods. The only cost chargeable to the consumer regarding the withdrawal from the contract is the cost of returning the goods (which, in the case of shipping, is charged according to the delivery service’s price list). In the case of sales contracts, the company may withhold reimbursement of payments received until the receipt of the returned goods or until the consumer has provided proof that they have sent the goods back.

In case the rejected goods have already been paid for, we will credit the invoice amount to your bank account, so please indicate it in your written message.

Complaints and refunds

In the event that the consumer has received the wrong type of goods compared to those ordered, or the goods received are damaged, the consumer may file a complaint  within eight (8) days of receipt of the goods by sending the complaint together with a copy of the original invoice to our address. In the event of a complaint, the consumer may, subject to legal restrictions, request the product to be replaced or repaired, or purchase price to be refunded.

The products you return should be unused and undamaged, in their original packaging and with all the accessories you received.

Material defects

The seller must deliver the goods to the consumer in accordance with the contract and is liable for material defects in the goods that become apparent within two years of receipt (ZVPot).

The defect is material:

  • if the item does not have the characteristics necessary for its normal use or circulation,
  • if the item does not have the characteristics necessary for the particular use for which the customer is buying it, which were known or should have been known to the seller,
  • if the item lacks the qualities and characteristics that were expressly or implicitly agreed or prescribed,
  • if the seller has handed over an item that does not match the sample or model, unless the sample or model was shown only for information.

Limitation of liability

The Provider shall make every effort to ensure that the information published in the Online Shop is consistent and up-to-date. However, product characteristics, stock and price can change so quickly that the Provider is unable to correct the information in the online shop. In such cases, we will inform the customer of any changes and give them the opportunity to cancel their order or exchange the product they have ordered.

Copyright

The online shop www.kgl.si/shop is the exclusive property of KGL d.o.o. All rights are reserved and any communication of information from the website within the online shop is only permitted with the written consent of the owner, as the website may contain information whose copyright is attributable to third parties. All infringers of copyright law will be prosecuted.

We reserve the right to change the Terms and Conditions without prior notice.

Protection of personal data

We guarantee the protection of your personal data under the law governing the protection of personal data.

The data will be used solely for the purpose for which you have provided it (offer, invoice, communication regarding your order, sending you information material).

Only authorised persons of our company have access to the data. We will never pass on your data to third parties. From time to time, we will send you an e-mail on new features in our offer.

You may request, in writing or by telephone, that we permanently or temporarily stop using your personal data for direct marketing purposes within 15 days and we will notify you within 5 days.

Complaint handling and settlement of disputes

The law of the Republic of Slovenia shall apply exclusively to the interpretation of these Terms and Conditions of Sale or any contract concluded between the Provider and the customer. The contracting parties undertake to settle all disputes amicably, and in the event that all out-of-court means of reaching an agreement have been exhausted, the competent court for the settlement of the dispute shall be the local court in the Republic of Slovenia having jurisdiction in the place where the registered office of the Provider is located.

According to the legal regime, the Provider does not recognise any out-of-court consumer dispute settlement provider as competent to resolve a consumer dispute that a consumer may bring under the Out-of-Court Resolution of Consumer Disputes Act.

A provider who, as a provider of goods and services, offers an online shop in the territory of the Republic of Slovenia publishes an electronic link to the Online Consumer Dispute Resolution Platform (ODRP). The platform is available to consumers at the following URL: https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show&lng=EN The above-mentioned regulation is based on the Out-of-Court Resolution of Consumer Disputes Act, Regulation (EU) No 524/2013 of the European Parliament and of the Council on online dispute resolution for consumer disputes and amending Regulation (EC) No 2016/2004, and Directive 2009/22/EC.

The Provider complies with applicable consumer protection legislation. The Company ensures an efficient and confidential complaints management system. All complaint have to be sent to sales@kgl.si.

The Company will acknowledge receipt of the complaint to the customer within 5 working days of receipt and inform the customer of the progress and duration of the complaint procedure.
